2024 Painting Contractor Subcontractor Forms

If your painting business is like most, you will take any type of job that comes across your desk... provided you have the resources to complete the job.  With that in mind, there will be jobs where you will not be a prime contractor (the contract is signed by you and by the property owner or owner's agent) but rather a subcontractor (the contract is signed by you and another contractor) and there will be some parts of your work on a contract that you will need to have a specialist subcontractor complete for you. 

For example... You are contacted by a General Contractor who needs you to do the painting portion of the contract the General has with a property owner to build a structure... in this case the agreement between your painting company and the General Contractor will be a Subcontract Agreement.

And... If you enter into a painting contract for a job that includes lead removal, chances are you will need the services of a contractor who specializes in, is certified or licensed for, and is trained and equipped to do lead abatement... In this case the agreement between your painting company and the lead abatement contractor is also a Subcontract Agreement... but a different type of a Subcontract Agreement than the one between You and the General Contractor mentioned above. 

Also consider that situation where you might use a single subcontractor on many jobs and, instead of writing a separate subcontract agreement for each job... you prefer one "blanket" subcontract agreement that details the basic expectations you have of the subcontractor and the subcontractors basic responsibilities to you. When a job comes along that you need the services of this "blanket" subcontractor... you can just give the subcontractor a scope of work and the price for the work on that particular project instead of giving your subcontractor a lengthy agreement with all the terms and conditions in a separate subcontract agreement, every time you want to use this subcontractor's services on a different project.  This is still another type of subcontract.

Be careful, if your Commercial Liability Insurance Policy requires this indemnification, and your subcontracts do not include this, the Insurance company can use this omission to deny your claim!
